Privacy Policy

1. General Information and Controller

This Privacy Policy informs you about the processing of personal data in connection with the use of our online offering and the Biotech Compute Platform 'Phonos'.

2. Types of Data Processed

• Inventory and Contact Data: Name, address, email (for contract execution and communication).
• Platform Usage and Metadata: IP addresses, API key usage, job logs, compute time, models used, data volume (for billing, system security, and error analysis).
• Content Data: The biological data uploaded by the customer is processed exclusively within the scope of computational processing and according to the customer's instructions. We treat this as strictly confidential commissioned data.

3. Purposes and Legal Basis for Processing

• Contract Fulfillment (Art. 6 (1) lit. b GDPR): Provision of the Phonos platform, execution of compute jobs, account management, and billing.
• Legitimate Interests (Art. 6 (1) lit. f GDPR): Ensuring IT security, troubleshooting, reach measurement (website), and optimizing our offering.
• Legal Obligation (Art. 6 (1) lit. c GDPR): Compliance with statutory retention obligations.

4. Transfer to Third Parties and Sub-processors

To provide the scalable compute infrastructure, we use cloud service providers as processors.

• Cloud Providers: Google GCP, Amazon AWS, Microsoft Azure (Storage and processing of compute jobs and customer data within the EU/EEA, unless otherwise agreed).

5. Rights of the Data Subject (GDPR)

You have the right to request confirmation (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), withdrawal of granted consent (Art. 7 (3)), and to object to processing (Art. 21). Furthermore, you have the right to lodge a complaint with the competent supervisory authority (Art. 77 GDPR).
