Alef ordering terms
1. Seller and scope
Your contracting seller is FyreFly Systems GbR, Bergstraße 16, 06366 Köthen (Anhalt), Germany. Contact: service@fyreflysystems.de. Ordering is restricted to businesses under § 14 BGB and public-law entities. FyreFly provides the software and order handling; Alpha Dichtungstechnik GmbH manufactures the products.
2. Review and place your order
Review and correct material, thickness, geometry, dimensions, quantity, certificate, billing and delivery details before submitting. A calculated preview is not an offer. Final submission constitutes your binding offer. Technical order or payment acknowledgements confirm receipt; a contract is formed only upon FyreFly’s express acceptance. Payments for orders we do not accept are refunded.
3. Drawings and technical review
Manufacture follows the agreed specification. You must hold the rights to submitted drawings and provide complete and accurate dimensions, material, quantity and known operating conditions. Review automatically extracted drawing data before ordering. Material guidance, pricing previews, geometry checks and AI analysis are aids; without express agreement they do not constitute technical consultancy or an assurance of suitability for a particular application. Safety-critical applications require separate professional assessment and express agreement. Our obligations regarding agreed specifications and statutory duties to advise and inspect remain unaffected. Oversize and unconfirmed special cases require a separate quotation. Certificates are issued only from actual manufacturer and batch records.
4. Prices, payment and invoices
Checkout shows net charges, shipping, VAT and the total. Only enabled payment methods are offered. Stripe handles online payments and invoices. Follow the due date, amount and transfer reference on the invoice or Stripe payment page. Production release and payment are tracked separately. Online checkout supports German billing and delivery addresses with 19% VAT. Foreign orders require a separate quotation and tax review. Structured e-invoices under EN 16931 (UBL 2.1, XML) are available for download once issued, in addition to the PDF receipt. Country-specific government reporting channels (e.g. IT-SdI, PL-KSeF, FR-PDP) are not served directly — please contact us before ordering. Electronic PDF documents are supplied with your consent where consent is required.
5. Delivery and defects
Displayed delivery dates are estimates unless expressly agreed as binding. The order confirmation states the agreed specification and schedule. Statutory remedies for defects apply, including any applicable inspection and notification duties under § 377 HGB. Individual agreements take precedence.
FyreFly Systems GbR is your contact for orders, invoices, delivery and contractual remedies for defects. Alpha Dichtungstechnik GmbH manufactures the goods as an independent company. Engaging the manufacturer does not release FyreFly from its duties as seller; you do not have to pursue Alpha before asserting claims against FyreFly. Any additional claims against the manufacturer remain unaffected.
6. Liability and applicable law
Our liability is unlimited for intent and gross negligence, culpable injury to life, body or health, and under mandatory liability provisions, including the German Product Liability Act. Liability for fraudulent concealment of defects and under an expressly assumed guarantee, according to its terms, also remains unaffected. For ordinary negligence, we are liable for breach of an essential contractual duty whose performance enables proper execution of the contract and on whose observance you may ordinarily rely; liability in that case is limited to foreseeable loss typical of the contract at the time of its conclusion. Otherwise liability for loss caused by ordinary negligence is excluded. These limitations also apply to our legal representatives and persons engaged to perform our obligations. They do not affect statutory rights to cure, termination or price reduction, or mandatory data-protection claims.
German law applies subject to mandatory provisions. Individual agreements take precedence over these terms. The contractual language is German; the English version is provided for information.
